Terms and Conditions
Last updated: August 2026
These terms cover your use of this website and the free tools on it. If we work together on a project, that work is governed by the separate agreement we sign with you, and that agreement takes precedence over anything here.
TME Brand Marketing LLC ("TME," "we," "us") is a limited liability company organized in Tennessee.
Using this site
You are welcome to read anything here, share it, and quote from it with attribution. Please do not republish our articles in full, scrape the site, or present our content as your own.
Everything on this site is our property or used with permission. That includes the writing, the design, and the StandOut Practice and Google GlowUp names.
The free website scan
The scan is provided as-is, for free, with no warranty. It analyzes publicly available information about a website and gives you a plain-language summary. It is a starting point, not a professional audit, and not a substitute for a real technical review.
The scan uses Google's PageSpeed Insights and an AI model to produce its summary. Both are imperfect. Results can vary between runs, can be affected by things outside our control, and may not catch every issue on a site.
Please do not make significant business decisions based only on a free automated scan. If something it flags matters to you, have it looked at properly.
We may change or discontinue the tool at any time.
How our client work operates
The details of any project are set out in the agreement we sign with you. What follows describes how we generally work, so you know what to expect before we talk.
You own your website
When we complete a build, it is yours. The site, the files, the hosting logins, the content, and your domain. From day one, and it stays yours if you stop working with us.
We do not hold work as leverage and we do not charge a release fee. If you leave, you take everything.
Payment
Project work is quoted up front. Payment terms are set out in your agreement. Payment plans are available and we would rather set one up than have you stretched thin.
Monthly maintenance is billed monthly and can be cancelled. We do not require annual commitments.
What we need from you
Projects move at the speed of the information we get. We will need content, feedback, photos, and access to accounts. If those stall, timelines shift, and we will tell you when that happens rather than letting a deadline quietly pass.
You are responsible for making sure any content you give us is accurate and that you have the right to use it. That includes photos, testimonials, and anything about your credentials or services.
Scope and revisions
Each project includes a defined scope and a set number of revision rounds, specified in your agreement. Work beyond that scope is quoted separately before we start it, never billed as a surprise.
Cancellation
If you cancel a project midway, you are responsible for work completed to that point, and you keep everything produced so far.
Monthly maintenance can be cancelled with notice as set out in your agreement.
What we do not do
We do not access protected health information. We build websites and work on search visibility. We do not have access to your practice management system, session notes, intake records, or client list, and we do not ask for them.
We are not attorneys, and this is not legal advice. We write about HIPAA, ethics, and licensing because they affect how a therapy website should be built. That is practical guidance from people who build these sites, not legal counsel. For questions about your specific obligations, talk to someone qualified to answer them.
We do not guarantee rankings. Nobody honestly can. Search engines change constantly and no one controls their results. We build sites properly, do the work well, and report on what actually happens. Anyone promising you a specific position on Google is not being straight with you.
We are not responsible for third-party services. Your hosting, your domain registrar, Google, your scheduling software, your email provider. We will help you work with them, but we do not control them and cannot be responsible for their outages, pricing changes, or policy decisions.
Our use of AI
We use AI tools in our work, including for research, drafting, and analysis. Everything is reviewed and edited by a person before it reaches you or publishes.
We do not put client information or confidential business details into AI tools. The full explanation is here.
Limitation of liability
To the extent permitted by law, TME is not liable for indirect, incidental, or consequential damages arising from your use of this website, the free scan, or our services. This includes lost profits, lost business, or lost data.
Where liability cannot be excluded, it is limited to the amount you have paid us in the twelve months preceding the claim.
The free scan carries no liability, as it is provided at no cost and without warranty.
Privacy
How we handle information is covered in our privacy policy.
Governing law
These terms are governed by the laws of the State of Tennessee, without regard to its conflict of law provisions. Any dispute will be brought in the state or federal courts located in Tennessee.
Changes
We may update these terms. When we do, we will change the date at the top of this page. Continuing to use the site means you accept the current version.
